Papershot Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and Quantum Byte Technologies ("Papershot", "we", "us"), a company registered in the Republic of Kenya. By signing in, creating a moment, joining one, uploading a photo, or otherwise using Papershot, you accept these Terms. Read carefully, we've kept the language plain.
1. Who may use the service
- You must be 13 or older. The first time you launch the app or sign up on the website, we ask you to confirm you meet this age minimum.
- If you are under the age of digital consent in your jurisdiction (16 in much of the EEA, 13 in the United States, 18 in Kenya), a parent or legal guardian must accept these Terms on your behalf and supervise your use.
- If you use Papershot on behalf of an organisation, you confirm that you have authority to bind that organisation to these Terms.
2. Your account
- Some features require an account. You can sign in with email, Sign in with Apple, or Sign in with Google.
- Keep your credentials secure. You are responsible for activity on your account.
- Report suspected unauthorised use to legal@papershot.com immediately.
- You may close your account at any time via Settings → Delete Account. Deletion is final after the 30-day grace window described in our Privacy Policy.
3. Purchases and refunds
- You can purchase additional guest capacity, longer photo retention, and other paid features. Prices are shown in the app at the moment of purchase.
- iOS payments are processed by Apple under the Apple Media Services Terms; Android payments are processed by Google under the Google Play Terms; web payments are processed by Stripe.
- Purchases are final except where required by mandatory law (for example, the 14-day right of withdrawal under the EU Consumer Rights Directive, the UK Consumer Contracts Regulations 2013, or equivalent Kenyan consumer protection rules) or where a technical issue prevented use.
- Refund requests: email legal@papershot.com within 14 days with the transaction ID. App store refunds are subject to Apple's or Google's policies.
- Custom pricing is available for needs exceeding 200 guests. Contact us for an enterprise quote.
4. Permissions and device access
- Camera access is used only while you are taking photos. Photo library access is used only when you are picking a photo.
- Push notifications are optional and can be managed in your device and app settings.
- You are responsible for mobile data and any carrier charges incurred while using Papershot.
5. Your content and moments
Ownership. You own the photos you upload.
Licence to Papershot. You grant us a worldwide, non-exclusive, royalty-free licence to host, process, transmit, display, transcode, back up, and otherwise operate on your photos and moment data solely as needed to provide the service to you and the moment's other participants. The licence is non-transferable except to our subprocessors and ends when you delete the content (subject to our standard retention windows).
Moment hosts. Hosts control access via invite links and codes, with visibility and participant limits. As host, you hold a non-exclusive licence to use participant photos only for running, viewing, sharing, and exporting that moment for personal, event, or internal purposes.
Participants. You retain ownership of your photos. You grant the moment host the limited licence described above. Photos may be visible to other participants based on the moment's settings.
You represent that you hold all rights necessary to upload your content, that the content does not infringe any third party's rights, and that you have any consents required from people depicted (especially minors).
We may remove content or suspend accounts that violate these Terms or the law. Papershot is not a backup service; keep your own copies of important photos.
6. Acceptable use
Do not:
- Break the law, violate others' rights, or upload unlawful, infringing, harassing, hateful, pornographic, sexually explicit content involving minors, or excessively violent content
- Upload other people's photos without permission
- Attempt to reverse-engineer, interfere with, disrupt, or overload the service
- Use bots, scrapers, or unauthorised automation against the service, except for accessibility tools you personally use
- Impersonate others or misrepresent affiliation
- Use the service in a jurisdiction subject to comprehensive embargo by the United Nations, the European Union, the United States, or the United Kingdom
7. Third-party services
Papershot uses vendors including Amazon Web Services, Stripe, Apple, Google (Firebase Cloud Messaging and Crashlytics), and Resend under their own terms. We are not responsible for third-party websites or materials you reach via the service. See /subprocessors for the current list.
If you send us feedback or suggestions, we may use them without any obligation to you, and you grant us a worldwide, perpetual, irrevocable, royalty-free licence to do so.
8. App store terms
Apple. These Terms govern the relationship between you and Papershot, not Apple. Apple has no support obligations. If the service fails to conform to any applicable warranty you may notify Apple, and Apple may refund the purchase price. Apple and its subsidiaries are third-party beneficiaries and may enforce these Terms.
Google. These Terms govern the relationship between you and Papershot, not Google. Use on Android must comply with Google Play policies. Google is a third-party beneficiary.
Apple's LAEULA. iOS downloads are subject to Apple's Licensed Application End User License Agreement, which controls in case of conflict for matters specific to the iOS download.
9. Copyright and trusted-flagger notices (DMCA / EU DSA / UK)
Copyright infringement claims must be sent by email to legal@papershot.com with "Copyright" in the subject line, and include:
- Your contact information
- Identification of the allegedly infringed work
- The specific location of the content on Papershot
- A good-faith statement that the use is not authorised by the rights holder
- A statement, under penalty of perjury, that the information is accurate and you are authorised to act on the rights holder's behalf
- Your physical or electronic signature
Repeat infringers may have their accounts terminated.
EU users. Under Regulation (EU) 2022/2065 (the Digital Services Act), you may submit a notice of illegal content to legal@papershot.com with "DSA notice" in the subject line. We will provide a statement of reasons for any moderation decision affecting your content and information about how to challenge that decision.
UK users. Under the Online Safety Act 2023 you may report illegal content via the same email. We respond as required by applicable law.
10. Disclaimers
The service is provided "as is" and "as available". To the fullest extent allowed by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. This clause does not limit any non-excludable statutory rights you may have as a consumer under EU, UK, Australian, Kenyan, or other local law.
11. Limitation of liability
To the fullest extent permitted by law:
- Papershot is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or business interruption.
- Our total cumulative liability is capped at the greater of (i) the amounts you paid Papershot in the preceding six months, or (ii) USD 100.
These limits apply even if a remedy fails of its essential purpose. They do not limit liability that cannot be limited under applicable law (for example, liability for gross negligence, wilful misconduct, fraud, death, or personal injury caused by negligence under EU/UK law, or non-excludable consumer-law warranties).
12. Indemnity
You will defend and hold Papershot harmless from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your content, your use of the service, or your violation of these Terms or the law. This clause does not apply to consumers acting outside any trade, business, craft, or profession to the extent prohibited by EU, UK, or other local consumer law.
13. Termination
You may stop using the service at any time. We may suspend or terminate access or remove content for violations of these Terms or the law, after notice where reasonably practicable. Sections on intellectual property, disclaimers, liability limits, indemnity, and dispute resolution survive termination.
14. Changes to these Terms
We may update these Terms. Material changes are notified in-app or by email at least 30 days before they take effect, except where a shorter period is required by law or to address a security issue. Continued use after the change means you accept the new Terms. If you do not accept them, you may close your account.
15. Governing law and dispute resolution
Governing law. These Terms are governed by the laws of the Republic of Kenya, without regard to its conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Consumer carve-out (EEA, UK, Switzerland). If you are a consumer resident in the EEA, the UK, or Switzerland, you also benefit from any mandatory provisions of the law of your country of residence. The choice of Kenyan law does not deprive you of those mandatory protections, and you may bring proceedings in the courts of your place of residence.
Consumer carve-out (other jurisdictions). If you are a consumer in another jurisdiction (including Australia, Brazil, Canada, or U.S. states) whose law gives you a non-waivable right to bring proceedings locally, this clause does not waive that right.
Informal resolution. Before filing a claim, please email legal@papershot.com with "Dispute" in the subject line. A 30-day resolution window applies.
Courts of Kenya. Subject to the consumer carve-outs above, you and Papershot submit to the exclusive jurisdiction of the courts of Nairobi, Kenya, for any dispute arising out of or in connection with these Terms.
EU online dispute resolution. The European Commission's online dispute resolution platform is available at ec.europa.eu/consumers/odr.
16. Other terms
- Export and sanctions. You must comply with applicable export, re-export, and sanctions laws. Use is prohibited in countries or by parties subject to comprehensive embargo.
- Severability. Unenforceable terms do not invalidate the remaining provisions.
- Assignment. We may assign these Terms in connection with a merger, acquisition, financing, or sale of assets. You may not assign these Terms without our consent.
- No waiver. Non-enforcement does not constitute waiver.
- Entire agreement. These Terms, together with the Privacy Policy and any other policies referenced, constitute the entire agreement between you and Papershot regarding the service.
- Language. The English version of these Terms controls. Translations are provided for convenience.
